Elihu Sherman Jr
1777 - 1841

I Elihu Sherman of the town of Ledyard County of Cayuga and State of New York do make and ordain this my last will and testament in manner and form following viz.

I give and bequest to my dear beloved wife Hannah all my estate real and personal except my wearing apparel, to have and to hold the use and occupancy thereof so long as she remains my widow.

I give and bequeath to my daughter Nancy a maintenance at home with her mother so long as she remains single and to have an outfit to be equal with her sister Minerva.
I give to my daughters Minerva Catherine and Nancy the Twenty acres of land known as Their lot to have and to hold equal or to sell and divide equal, providing my real estate shall be clear of debt at the time my wife Hannah is done with it, if not then the said Twenty acres must pay a share of the debts in proportion to its value with the rest of my real estate.

I give and bequeath to my son Alden the equal and undivided half of all my wearing apparel, together with what property he has had from me before.
I give and bequeath to my son David one dollar together with what property he has had from me before.

I give and bequeath to my son Zephaniah Fifty dollars together with the equal and undivided half of my wearing apparel. The fifty dollars to be paid after my wife Hannah is done with the property.

I give and bequeath to my son Russell Three hundred dollars in case he stays at home with his mother and takes charge of the property and works it on shares or on some other conditions as he and his mother may hereafter agree. And I give and bequeath to my son Russell the equal and undivided half of all my property that my be left after my wife Hannah is done with it and after paying the above mentioned sons.

I give and bequesth to my son Howland the equal and undivided half of what property of mine that is left after my wife Hannah is done with it, and the above mentioned sons are paid out of it.

I hereby nominate constitute and appoint Russel Sherman and Enoch Brotherton Executors of this my last will and testament hereby revoking all other and former wills by me at any time heretofore made.

In witness whereof I have hereunto set my hand and seal the Thirteenth day of April one thousand eight hundred and forty.

Signed sealed published and declared by the said Testator Elihu Sherman as and for his last will and testament in the presence of us who have subscribed our names as witness thereto in the presence of the said testator. And further I hereby nominate constitue and appoint William H Squiers, Daniel L Avery, Cesal C White as three suitable men to decide all differences that may arise between the heirs in consequence of this my last will and I further say the decision of the majority of the above three men shall be final in all such differences.

ESTATE

I, Coral C White and I, Ledyard Morgan do swear that I will honestly and impartially appraise the personal property of Elihu Sherman deceased, which shall be exhibited to me according to the best of my knowledge and ability. Sworn and subscribed the 26th day of July 1841 before me,

A true and perfect Inventory of all and singular the goods, chattels and credits of Elihu Sherman deceased, made the 12th day of August [1841] by E Brotherton & R Sherman Executors with the aid of Coral C White & Ledyard Morgan appraisers duly appointed and sworn according to law.

The following articles are set off to Hannah Sherman the widow of the deceased, to which she is entitled by law, and not appraised, to wit: (See 2d vol Revised Statues page 83.)

1 Cow; 10 Sheap & the wool of the lams; 2 Hogs; 3 Beds 3 Bedsteds & Beding; for the same; 2 Spinning wheels; 1 Table 1 Candlestand; 6 Chairs; 1 Looking glass; Dishes Cooking Utensils etc; necessary for family use.
